Terms and conditions
Please take some time to read and understand these terms and conditions as they contain important information regarding your legal rights and obligations, including various limitations and exclusions.
By accessing our website at https://onthehousegroup.com/ and our social media channels (our “Sites”), and by using our services, all of which are brought to you by On The House Group Pty Ltd (ABN: 60 674 655 175, ACN: 674 655 175), you (the “User”) signify that you have read, understood, and agreed to be bound by these Terms of Use (“Terms of Use” or “Agreement”). Your access to our Sites and your use of our services are conditional upon your acceptance and compliance with all terms, conditions, notices, and disclaimers contained in this Agreement and anywhere else on the Sites.
We reserve the right to amend the terms of this Agreement at any time. Users and Advertisers should check this Agreement from time to time to stay up to date regarding any changes. If we amend this Agreement and you do not notify us to the contrary, we will take your continued use of the Sites as your acceptance of the amended Agreement terms.
We reserve the right to suspend or revoke access to our dispensers or services at any time if we determine that a user has violated these Terms, submitted false information, or attempted to manipulate our systems or exceed usage limits.
User Obligations
We require that all Users of our Sites comply with certain standards of behaviour when using our Sites. The Sites, to the extent applicable, are only available for your personal use and are not to be used for any business or commercial purpose. You will not use the Sites for the purpose of advertising, promoting, or soliciting any goods or services, or otherwise for engaging in trade or commerce in any form.
Dispenser Access & Account Creation
To access free period products through On The House smart dispensers, Users must create an account by scanning a QR code and completing a short form on our web application. By doing so, Users agree to have dispense history tracked to enforce monthly product limits (for example, four dispenses per user per month). This process is necessary to ensure fair distribution and prevent abuse of the service.
By registering though our QR code system, Users consent to be added to On The House Group’s internal communications database. We may contact you via email or SMS with updates about your dispenser usage, service notifications, or marketing communications. You may opt out at any time via the unsubscribe link or by contacting us directly.
On The House Group’s Obligations
On the House Group will retain all Personal information you provide in accordance with our Privacy Policy.
On the House Group will provide the Sites and content to you. On the House Group will provide free, sustainable menstrual care funded through a unique advertising model by which advertisers can purchase advertising space on our products.
On the House Group will allow brands who engage with On the House Group through the Sites to advertise through digital dispensers placed in high-traffic venues. These dispensers may:
Feature digital screens that display static and video ads;
Provide real-time audience data measurement, including impressions and engagement metrics;
Leverage QR codes and sign-up systems to increase conversions and customer lifetime value;
Offer a digital offers page platform (On the House Group website) where deals & offers are displayed to maximise conversions;
Offer category exclusivity with options for 100% or shared ad placements;
Ensure high brand recall rates, with over 70% unprompted campaign recall;
Enable flexible campaign terms (2, 4, or 6 months); and
Provide OOH (Out-Of-Home) impact that extends in-home, as users take the advertised products home.
On the House Group will allow brands who engage with On the House Group through the Sites to sponsor dispensers in venues with varying levels of foot traffic, such as:
High-foot-traffic locations (e.g., airports, transport hubs, CBD public restrooms); and
Standard-foot-traffic locations (e.g., shopping centers, universities, gyms, bars, pubs).
On the House Group will partner with venues (distributors) to install smart digital dispensers that provide free period products to their patrons at zero cost. These dispensers will:
Be fully funded by advertising revenue;
Dispense organic and biodegradable sanitary pads;
Be installed, maintained, and restocked by our team at no cost to the venue;
Be able to be accessed via a digital wallet card or by signing up on the touchscreen;
Collect strictly confidential user data, with consent-based utilization; and
Be tamper-proof, fire and electrical safety compliant, and come with comprehensive insurance.
On the House Group will take full responsibility for machine-related incidents and cover liability for damages in relation to the above-mentioned smart digital dispensers.
On the House Group relies on partner venues to host our dispensers. While we monitor performance and stock levels remotely, we are not liable for interruptions to machine access caused by venue-specific circumstances such as closures, maintenance, or power disruptions.
All personal information collected or processed though our services is handled in accordance with our Privacy Policy, which ourlines our data handling, sharing, and security practices.
Advertiser Data Sharing
On the House Group may provide advertisers with campaign analytics and User engagement data in anonymised or aggregated formats. We will never share Users’ identifiable personal information (for example name, email, date of birth) with any advertiser unless Users’ have explicitly consented to such sharing at the time of registration or interaction.
Social Media
As part of the Sites you may choose to connect with us through various social media platforms such as Facebook, Instagram, Youtube, LinkedIn, and X. In order to connect with us in these ways, you will be required to set up your own account with the relevant social media site and you will be subject to the terms and conditions as prescribed by the operators of these sites. On the House Group is in no way associated with or endorsed by any social media channels and is not responsible for any content posted by Users or other third parties through such sites.
On the House Group’s Content
Except where expressly stated otherwise, On the House Group makes no representations about the content and suitability for any purpose of the information contained on the Sites. This information is provided “as is” without express or implied warranty of any kind.
Except where expressly stated otherwise, On the House Group makes no representations about the content and suitability for any purpose of the information contained in the advertising content and material provided by its Users and Advertisers.
On the House Group shall not be liable for any damages whatsoever including any special, indirect or consequential damages resulting from loss of use, data or profits, whether in an action in contract, negligence, or other tort, arising out of or in connection with access to the Sites or the use or performance of information contained in it.
Digital Offers Page Usage & Tracking
On the House Group’s website may include a digital offers page where sponsored offers from advertisers are listed. User interactions with this page (for example clicks, session duration, and redemptions) may be tracked to provide advertisers with anonymised performance reporting. We are not responsible for the accuracy or availability of third-party offers. Redemption of any third-party offer is at the Users’ own discretion and risk.
Your Content
You must ensure that any advertising material provided by you to be published by On the House Group complies with any and all applicable laws, rules, and regulations, including but not limited to the Australian Consumer Law, being Schedule 2 to the Competition and Consumer Act 2010, the Therapeutic Goods Act 1989, and the Therapeutic Goods (Therapeutic Goods Advertising Code) Instrument 2021.
On the House Group shall not be liable for any breach of any and all applicable laws, rules, and regulations caused by the publication or communication of your content to the public.
Indemnity
On the House Group accepts no responsibility for your use of the Sites or On the House Group’s Services, and you agree to indemnify On the House Group and its employees, officers, agents, and contractors from and against all actions, proceedings, suits, claims, and demands brought or made against On the House Group by any person arising from or in consequence of your use of the Sites or the Services, and from and against any damage, loss, cost, or expense suffered or incurred by On the House Group as a direct or indirect consequence thereof.
Intellectual Property
The On the House Group name and logo used on the Sites are registered trade marks and may not be used without the prior specific and express written permission of the trade mark owner.
The content provided on the Sites by us (whether produced by a third party or otherwise) may include copyright material. All content and other information, text, images, graphics, software, applications and advertisements contained on the Sites are protected by Australian copyright law, and all rights are reserved in this regard. Except where expressly stated otherwise, all material on the Sites is presented for your information only. Users are not permitted to download any material except when reasonably necessary to access the Sites or to participate as a User.
When you access the Sites, you agree to do so on the following conditions:
Except as noted above, you may retrieve, review, or download the material for your own personal information purposes only.
You may save a local copy of the material or print material from the Sites for you own personal information and to inform others about it, but you may not charge any fee for any use or commercial exploitation of any material on the Sites.
Any copyright notice or mark appearing on any material on the Sites must be included on any copy you make.
You must keep all material intact and in the same form as presented on the Sites. You may not modify it without the express permission of On the House Group.
You must not use the Sites or any of the material contained on the Sites for any purpose which is unlawful, prohibited under this Agreement, or which otherwise violates any right of On the House Group or any other owner of any rights in the material contained on the Sites.
Links and Advertisements
The Sites may contain hyperlinks to internet sites operated by third parties. On the House Group is not responsible for the contents of any linked sites, and the inclusion of a link does not imply any endorsement of the linked sites by On the House Group. Any link that takes you to a third-party site should be clicked on at your own risk.
Governing Law
This agreement will be governed by the laws of New South Wales, Australia. If any provision of this agreement is found to be invalid or unenforceable by a Court of Law, it shall be severed and will not affect the remainder of the agreement, which will continue in full force and effect.
All rights not expressly granted are reserved.
